Abstract

The present work tries to illustrate brings over of the phenomenon that one comes repeating in the practice of our civil courts in the last times, consisting of the massive purchase of litigious credits on the part of investment funds in his most foreigners, who acquire them in great number by means of an alone juridical business before notary, for the only price, and to the margin of the debtors who ignore completely the existence of the transfer in favour of the bottom buyer.

Equally this article centres on synthesizing the diverse answers that before it have made our courts clear, analyzing his juridical arguments and the reasons for which one speaks, not of a transfer of litigious credits but of a transfer of contract as juridical differentiated figure.
