The environmental evaluation of projects, plans and programs regarding Natura 2000 (normative and case-law issues)

The environmental evaluation of projects, plans and programs regarding Natura 2000 sites has been treated by the European law separately from the ordinary evaluation procedures regulated by the Directive 42/93/CEE, a.k.a. Habitats Directive. Nevertheless, its generality and the lack of a procedure has required a tremendous courts’ effort, in order to elucidate the steps to take to correctly apply this regulation.
In this paper we will carry out an integral analysis of this specific type of evaluation and put in order the different jurisprudential guidelines to shed light over certain matters not clearly enough treated in the regulation. To achieve this, we will cover the whole range from the kinds of activities attached to this evaluation and the requirements they must hold on to, to the transposition made by the Spanish legislation.
