Abstract

The following article adresses how the system of civil liability is going to be affected by damages and injury arising from traffic accidents caused by a collision with game species, as a consequence of the coming into force on 9 May, this year, of the Law 6/2014 of 7 April, by which the Law on Traffic, Motor Vehicle Traffic and Road Safety, approved by Royal Decree 339/1990 of 2 March, has been modified. The new wording given by the above-mentioned law, the Ninth Additional Provision, implies a complete change in the civil liability system to the extent that the driver moves from being uniquely responsible when the accident has occured due to the non-observance of the road traffic rules, to being always responsible for the accident, except in the referred cases in the provision itself.
