Abstract

The performance of any law enforcement officer, police or civil guard, as appropriate to detain any person should be covered in a legal case under the law, since otherwise it could be committing a criminal offense. If such detention by these agents is not caused by the possible existence of a criminal offense, or the enforcement of safety and security, crime of illegal detention is unquestionable, but not indubitable the application of the standard expected individuals (preferred type), which mitigates the penalty, for consideration with public officials.
