The right to work and the right to strike: a necessary law

The absence of an organic law on the right to strike has created uncertainty on how to treat this right. Pre-constitutional legislation currently regulates striking in Spain, subject to major changes resulting from a decision from the Constitutional Court. The courts judge if the strike is legal or ilegal when the possible damage has already been caused to strikers, non strikers or the consumer.
The right to work hasn't got a similar protection as the right to strike, and possible violations of the right to work don´t allow the presentation of an appeal brought on grounds of violation to these rights and liberties. In our opinion, this reflects the consequence of a collective point of view about the right to strike, leaving in the background the situation of workers who want to join or not strike.
