Protection of the fundamental right to physical and moral integrity as a factor for social inclusion

Abstract

The core of this study is the legal means of protection against poverty and social exclusion; focusing on the Spanish system of rights and freedoms, in particular on the safeguard of the right to physical and moral integrity.
Furthermore, the approach has gone beyond the Spanish Constitution, studying as well the Spanish legislation which develops the fundamental rights. In order to give the study a more pragmatic perspective, the relevant case law from the Constitutional Court and the Supreme Court has been also analyzed.
