The legal challenges of the reverse mortgage

Fifteen years ago reverse mortgages were regulated for the first time in Spain by means of Law 41/2007 first additional provision. Since then, few legal changes have been made to said financial product that, over the course of years, has not increased the volume of formalized transactions (to the extent it is considered a residual product).
However, during the same period, the business of mortgage-backed lending to individuals to acquire a house has experienced a remarkable legal revolution, boosted, in a first instance by the Supreme Court decisions that declared the nullity of several clauses included in mortgage-backed loan public deeds and, afterwards, its transformation has been promoted from Europe, with the transposition of Directive 2014/17/CE to our legal system.
In this paper, reverse mortgages are analysed with a forward-looking purpose, analysing its current regulation in order to predict the legal risks that formalizing these transactions at present may entail for lending entities.
