On emergencies, geolocation and rights: An inquiry concerning an overtly dangerous regulation for fundamental rights

Abstract

Is the emergency declared because of the covid health crisis being used to curtail the citizens’ fundamental rights? Even if there’s an affirmative answer, would that curtailment be justified on behalf of the supreme good, i.e. life & health? Should we leave in the nanny state’s hands the protection of those beloved goods or, on the contrary, run away from paternalistic approaches and preserve the liberties system provided in 1978 Constitution above all? The use of new technologies before the health crisis may have undermined certain rights of a citizen bedazzled by the wide range of opportunities displayed but unconscious of the price paid for unlimited connection, nevertheless, the discussion has not been brought on until now because, unfortunately, there is also a political bait in it. Or maybe the ones proclaming a serious threat to liberties are right.

Whatever the answers may be, this paper aims at leaning out the new legal reality window lying beneath certain regulations passed while the state of alarm ordered in Royal Decree 463/2020, of 14 March, was in force, and whose constitutionality has been questioned regarding the essence of the state of alarm concept.
