Law 15/2015, of july 2: new legal regime of voluntary jurisdiction

Abstract

We propose the analysis of the new regulation implemented by our legislator through Law 15/2015, of July 2. It is a significant event, thinking about a better way than the ankylosed and old procedural law of 1881 and other rules that were in charge of it. The study covers different aspects, both expository and critical: to review the difficulty of a univocal conception of the institution, to observe the primordial features of the new standard and to detect its propulsion and impact.
