Probation in the new reform of the Penal Code. Problems

The traditional monist in our criminal law system was the subject of a shy review by the Organic Law 5/2010, introduced a measure of security, probation, which should be enforced after con-viction for dangerous sex offenders. The new reform of criminal code pending parliamentary approval, maintains such a measure and introduce technical improvements in its regulation. The object of this article focuses on the analysis of the aspects not covered by this new reform regarding the probation postpenitentiary that they may in fact pose problems of application, every time when it comes to security measures a procedure becomes essential to clear and precise execution, given the special indeterminate nature of its content and duration.
