Abstract

A woman appears at the station and declares about her husband's crimes. If Prior is advised of his right to do so, and if, then, in the judicial view decides not to declare, to the first statement is not given the same value, because no legal impossibility irreproducible in oral act and that witness statement not covered by the exception in Article 730 of the LECr. They are two different things. Nor can read the initial statement of the woman who decides not to testify later. Thus, reproduction and contradiction are out of this field and the content of articles 730 and 714 of the criminal procedure law.
