Abstract

The declaration of an insolvent person through self declaration of bankruptcy, has regulated consequences regarding their capacity to act in future judicial proceedings seeking to bring. However, the limitations on that ability when it comes to cases pending and open to the insolvency date, are only partially regulated, often leading to problems of interpretation as in the proposed case. Specifically addressing the problems that adheres to the legal capacity of the bankrupt proceedings regarding filing of appeals, and cases where it is necessary to obtain authorization or not the receivers. We analyze the two views with their respective arguments, pursuant to bankruptcy rule.
