Abstract

The Supreme Court has declared invalid all awards local digital terrestrial television adopted by the Generalitat Valenciana in 2006 to estimate the appeal brought by a local television Elche. The High Court rules that the Procurement which was to assess the various candidates in obtaining licenses, not weighted the criteria set out in the tender documents in particular the proposal that she submitted to the contracting and value offers candidates the report commissioned from an outside company. It stresses that the Committee shall so flagrantly violated its function of evaluating the bids, which is «self and non-delegable», and led to their resolution so that did not allow «know the reasons why the appellant that its bid was not selected».
