Abstract

The doctrine of the Court has repeatedly held that the right to effective judicial protection without helplessness (art. 24.1 CE) ensures that all potentially affected by the decisions handed down in a court the right to know its existence, so that they have the ability to intervene in it, be heard and to exercise the defense of their legitimate rights and interests.
This need to promote the defense, as far as possible, through appropriate conflict imposes on the courts a special duty of care is especially important in the implementation process.
