La consideración de objetivos de desarrollo sostenible en los procedimientos de reestructuración empresarial

Este trabajo ha obtenido un accésit del Premio Estudios Financieros 2024 en la modalidad de Derecho Civil y Mercantil.
Este trabajo analiza el papel que juega la sostenibilidad en las operaciones de reestructuración empresarial realizadas en el marco de procedimientos de insolvencia, tanto concursales como preconcursales. A estos efectos, se revisita el debate sobre los fines de los procedimientos de insolvencia y sobre quiénes son los stakeholders en los mismos. En relación con esta cuestión, se analizan con detalle las últimas tendencias internacionales en el derecho de la insolvencia y, sobre la base de lo anterior, se ensaya una aproximación teórica en torno a la admisibilidad y la conveniencia de la consideración de intereses basados en la sostenibilidad en los procedimientos de insolvencia y al impacto que ello puede tener sobre los intereses de los acreedores.
