Abstract

This paper analyzes the Spanish state's ability to intervene in the economy, in light of the Spanish Constitution. The importance of it is justified in view of the recent interventions of the state in various fields in which it is supposed to prioritize the free market game. However, the terms used in the article 128.2 of Spanish Constitution (article governing public economic initiative) are very ambiguous, so that the debate about his meaning and significance will always be in force.
