Promotion of arbitration versus increase of litigation

Abstract

The current situation of the significant increase in litigiousness leads us to develop an analysis of the need to promote alternatives to the prosecution of conflict, as the institution of arbitration, to refer matters that might be more appropriate to a resolution by referees reducing the high rate of litigation that has overwhelmed the Courts of First Instance. Thus, about already saturated state of civil justice, the economic crisis has led to the need to seek alternatives to «the judiciary» as positive methods of conflict resolution.
