Abstract

The Supreme Court has come to give the reason to the Autonomous Administrations that denied the educational concert to diverse colleges in which education differentiated by sex is given, using as essential argument the breach of the article 84 of the Organic Law of education relative to the pupils' admission in whose third paragraph adds that «in no case there will be discrimination because of birth, race, sex, religion, opinion or any other condition or personal or social circumstance». Furthermore, the High Court rejected the interpretation "in some way supported" the right to establish private schools supported by public funds and in the selection of students, reminding us that regulatory mandates on the promotion of equality between men and women or to promote equal rights and opportunities involved in maintaining the model of co-education in all stages of education as the only capable of obtaining government grants.
