Los marcos de control de riesgos fiscales en un contexto post-BEPS

Resumen

Este trabajo expone de forma sintética la transformación del modelo de cumplimiento tributario de las grandes empresas como consecuencia de un conjunto de factores entre los que destaca el desarrollo de los principios derivados del buen gobierno corporativo en materia fiscal. La implantación progresiva de los marcos de control de riesgos fiscales (tax control frameworks) también está ejerciendo influencia sobre el modelo de cumplimiento tributario de las grandes y medianas empresas. A lo largo de este trabajo exponemos el marco del buen gobierno corporativo en materia tributaria y la funcionalidad y contenido de los denominados tax control frameworks en el contexto actual, donde convergen mayores exigencias derivadas del marco de buen gobierno corporativo, un redimensionamiento e intensificación de la transparencia fiscal, regulaciones tributarias más inestables y complejas, y administraciones tributarias dotadas de mecanismos más sofisticados de gestión de riesgos fiscales.
