The interest of the judgements in which the Court of Justice of the European Union concludes that the Spanish Law is not in accordance with the European intellectual property Law is undeniable. The main reason is the necessity to create a harmonized framework to fight against piracy of works protected by copyright on the internet. The role of the Spanish judges in some important preliminary questions of the Court of Justice of the European Union is remarkable, as well as the effort made on applying the Spanish Law in accordance with the interpretation given by the Court of Justice of the European Union. This article studies the European judgments on the right of communication to the public of works by online and offline means, the evolution of the Spanish more recent judgments and the modification to the Spanish IP Law and some European proposals.
