Legal protection of websites. Second part. Comments on contracts related with creation and running of websites

This article continues the first study on legal protection of websites, published on number 129 of this review. In that first article we analyzed the potential of copyright and sui generis right to protect both the structure and the content of a website. However, in this second part we study the contracts available when it comes to creating websites and how the decision among these several possibilities could entail one or another impact on the above-mentioned rights. We also examine the legal rules applicable in defect of agreement on the material, geographical and temporal scope of transfers of intellectual property rights. In short, with these two articles, we try to develop a global view of the matter, deciding what is the most suitable way to protect the components of a website.
