Abstract

In the supposed present the Constitutional Court comes to put order in the action of a jurisdictional organ that unadmitted to step a resource for the fact that the appellant had not recorded the warehouse to be able to realize the judicial resource established in the Ley Orgánica del Poder Judicial in his reform of the year 2009, when it was situated dependent on the recognition of the right of the juridical free assistance that it would have exempted of effecting the above mentioned consignation. As soon as the resource was unadmitted the benefit was granted, in spite of which the jurisdictional organ, in spite of the fact that it had occasion to alter his decision across an incident of nullity of actions, supported his decision what at last supposed injuring the right to the judicial effective guardianship of the appellant.
