Abstract

The case deals with the problems that arise with a building license for enclosure of an estate considered protected from urban development. Problems occur in the instruction of the procedure such as not correcting the faulty request resulting in the withdrawal by the City Council of the application or by the omission of a requested report. The license is finally granted but, given the delay in starting the works, the license expires. As this resolution was not notified to the applicant, the latter begins the building works and receives an inspection on behalf of the city council by an official who was ineligible to any office or public employment due to a criminal sentence .This official proceeds drafts a statement of the supposedly illegal works and suspends them. Finally the case raises a process of demarcation of the property from a municipal property and the possible filing of an administrative appeal against a provisional approval of the General Urban Development Plan.
