Abstract

Data Protection is a fundamental right linked to privacy but with its own entity; and it is interpreted as a group of powers involving the right to dispose the data (the right to be asked for consent to the collection and manage of them) and the right to access to data, and to require the rectification, blocking or erasure them. Right protected in Spain by the article 18.4 of Spanish Constitutional Law, where is based the right to require the erasure of personal data thanks to Organic Law 15/1999 about Personal Data Protection.

In this research we study if this right can affect Catholic Church's baptism books, or if it would be religious freedom (article 16 of Spanish Constitutional Law) the right to be considered in relation to baptism books. Regarding religious freedom we must think about two different perspectives: Catholic Church confession as a group entitled the right of religious freedom against external aggressions. But also individual religious freedom perspective, with the possibility of belonging or not to one confession, and the right to leave it in any time, and eventual consequences of this decision in relation to baptism books.
