Abstract

In Europe we live immersed in a plurality of constitutional law systems: state and European Union systems. This could conduce to conflict situations, almost in a theoretical perspective. Because of that, we try to explain and resolve the fundamental rights protection in European Union with the theory called «plural constitutionalism». However, we can feel doubts about this theory, that we can see like an «artificial construction» that would hide real problems in the protection of fundamental rights in the European Union.
