Abstract

The Supreme Court has overturned a previous judgment of the Superior Court of Justice of the Basque Country which had confirmed the legality of an administrative decision which meant the exclusion of a probationer to achieve a career position. The High Court criticizes that such exclusion would have a decisive impact sociometric a test of character tending to ascertain the acceptability of the subject by their peers, considering that the test was flawed attended the quality of living and peer was undermined both by the spread of hoaxes and false because the person concerned has been subjected to degrading and humiliating treatment by a large group of peers.
