The last juriprudential pronouncements of the Supreme Court on the reversion in the expropriation in case of infrastructures executed partially, indicate a doctrine that already was consolidated in general lines but that has been outlined in consideration of the concrete circumstances of every case. This way, a project of expropriation, of execution opened in the time depending on the evolution of the needs of that one and that, therefore, has not been executed in its entirety, does it assemble the legal requirements to start the institute of the reversion? … and if the project not only executes partially but it is not entirely defined from the beginning, without definite and concrete period of execution?
The last judgment of the Supreme Court of june 26, 2012, dictated in the resource of cassation number 3533/2009, appears this question, evoking the juriprudential general doctrine in the matter and giving solution to the concrete case. This article tries to sum- marize the doctrinal corpus of the Supreme Court in relation with this concrete matter, stopping the analysis in the last jurisdictional mentioned resolution.
