Abstract

The Supreme Court has annulled diverse articles of the Decree that arranges the second cycle of infantile education of the Council of Education of the Autonomous government of Cataluña, declaring void the articles that they define the Catalan as language normally used as traffic language in the education between the three and six years. This judgment estimates the resource presented against a judgment of the Top Court of Justice of Cataluña on the Catalan in the school who failed in favour of the linguistic dip. According to the TS, for constitutional being the Decree of the Autonomous government of Cataluña should recognize the right of the pupils to be enrolled in school in Castellano, without determining that is requested for whom it possesses it to individual title, or what is the same thing, the regulation norm, last normative product, has to assume explicitly this constitutional doctrine and declare the educational and traffic character of the Castellano, together with the Catalan, so that if this it is the habitual language of the pupil this right has to recognize him without need of that should be urged, clarifies the failure. It rejects the High Court that the Castellano «is still had reduced in his use by that of object of study of one more subject, without his utilization become effective as educational and traffic language in the education».
