Abstract

The presumption of innocence does not entitle you to be convicted without proof of valid charge, except for exceptional cases-is constitutionally obtained admitted at trial, that was rational and explicitly valued, giving reasons, the judgment, and refers to the core elements of the offense. When the test is usually referred to as circumstantial, to be meritorious incriminating conclusion, it is necessary that the facts or facts-based indicators are several, are well probatively accredited by direct call test, spilled onto the main fact or assignment object, and that the inference, made from those leading to the latter, is rational, based on maximum reliable experience, and count with sufficient motivation. No deception has any ability to integrate the crime of fraud. The law requires it to be «pretty», and thus requires weighing the sufficiency of the simulation truth to mislead, under current social use in the field of activity in which the conduct came under review.
