Abstract

Nullity of the limit of age of 30 years established in the Regulation of the selective processes and of formation pa to form a part of the State police of 1995, protecting this way a citizen who had contested it for thinking that his application supposed a discrimination when it tried himself to appear to the summons of free revenue in the executive scale of the state police of 2007 and 2009. In this respect, the Room of the Contentious-administrative of the High Court rejects, for lack of legitimization, both resources presented in this respect by an Association anti-discrimination, though it protects in a personal capacity the representative of the same one, who had been excluded from both summons for having more than 30 years. The judgments warn that the rule in recounted to the maximum age «is that it is not different that the established one for the necessary retirement», though it is possible to establish low others for law, «in all that you demur, that certainly will have to be justified from the point of view of the equality», which does not happen in case of the resolutions dictated in his day by the Headquarter of the Police.
