The Ministry of Interior is revoking the public utility with a favorable report from the Ministry of Economy and Finance, to those associations which make economic activities on the market, under the argument that economic running carried out in the market where competition exists can not be but private interest. And if that entity shall enjoy the tax benefits of Law 49/2002 could undermine competition with commercial companies. And if that entity shall enjoy the tax benefits of Law 49/2002 could undermine competition with commercial companies. Thus it can not be of public utility or to enjoy the tax benefits. In practical terms, this means excluding associations that are self-sufficient and force them to constitute under the form of foundation, which are able to perform economic operations. The purpose of this study is to analyze the arguments of the Ministry of Interior to revoke the public utility, understanding the author that this interpretation is not correct.
