Pensions and budget extension: an unlawful pension indexation passed by a royal decree as a proof of badly needed reform

One of the most controversial aspects of the current regulation on public pensions in Spain is indexation. After the 2013 reform, this revalorization mechanism has not called any attention up to the moment when inflation has returned to more common valued. From that point onwards, the indexation formula starts showing the risk that it implies for pensioners, given the fact that the 0,25 % annual increase (the legal minimum) is not enough to guarantee the purchasing power of pensions. At the same time, it is to be noted that it has not been possible to pass the Budget Bill in due time in 2016 and 2017; therefore, a budget extension has been initially approved those two years. This paper analyses the legal terms of said budget extension. Following the Council of State’s reasoning, it concludes that the 0,25 % increase channeled through a royal decree violates the principle of budgetary legality.
