Abstract

This article is focused on analysing the administrative sanctioning procedure in the social order, in light of the new Law 23/2015, of 21 of July, Authorising of the Inspection of Work and Social Security, and the entry into force in October the 2nd 2016, of the Laws 39 and 40/2015, of 1 October. The study undertaken reveals certain adjustment requirements of the special law into general law, particularly on regulations basis, which on the one hand correct the legislative distortions and the lack of coordination, and, on the other, clarify the legal regulation introduced by Courts and Tribunals. Furthermore, it reveals difficulties due to the dispersed responsive competencies.
