The Court of Justice of the European Union in its Ruling of May 16, 2024 (case C-673/22) has responded to the request for a preliminary ruling filed by the Social Court N.º 1 of Seville regarding the extension of maternity leave for biological mothers in single-parent families. Specifically, this concerns the interpretation of article 5 of Directive 2019/1158, in relation to Recital 37, and its compliance with article 48.4 of the Workers' Statute and articles 177 to 179 of the General Social Security Law.
