Abstract

The European Social Charter is an important international instrument that does not enjoy the practical impact it deserves. In this work we proceed to an approach to this norm, to the problem of its self-executing condition or not, to the concept of «case law» of the European Committee of Social Rights, and the study of the difficulties that could explain the little repercussion that the Charter has in the judgements of the social jurisdiction, all from the perspective of the function of the Supreme Court and the regulation of the labor appeal.
