The socio-labour incidence of Gibraltar in the province of Cádiz: the flow of workers through the fence and its impact in the Spanish Public Social Security System

The presence of Gibraltar, as a border of province of Cádiz, has set, historically, Cádiz labour reality, specially the area known as Campo de Gibraltar or Bahía de Algeciras. The flow of people through the fence/frontier (la verja), particularly Spanish workers that have their work in Gibraltar, under both regular and irregular basis, that makes The Rock the main employer of the province, leads to specific problems about the working conditions of such workers and the implications in our Social Security System. Further the pretentions of nation sovereignty, the attainment of the European Single Economic Area requires the South of Europe to be an homogenous social and economic area based on free competition among States, institutions and business, enforcing freedom of establishment, freedom of movement for people, workers, goods and services, in equal just terms and legal certainty, in the existing European legal framework, respecting and in compliance with European Union directives and regulations, as well as the sovereign states own laws, to stop the peculiarities of Gibraltar inside the European Union, invoking the non-compliance that leads us way from that objective.
