Abstract

There is a real boom in Spain about entrepreneurs and, in general, about the business initiative.

Nowadays, the entrepreneurship is shown to us as the way Spain is going to create enough jobs for the six million of existing unemployed people, when reality is that any business activity implies a clear risk, not having many of the entrepreneurial initiatives a good conclusion as long as they have been initiated due to the desperate fact that the entrepreneurial did not find any job and further these initiatives do not have a solid start point apart from the interest on developing a business activity.

Additionally, if we add to the aforementioned issues the traditional burden of the Spanish bureaucracy for the incorporation of business corporations, one of the most burdensome tax system in the world and a historical lack of financing, we have in hand all arguments to urge for an Entrepreneurs Act that really gives an answer and a solution to all these stressful problems and which makes it easier, stimulating and encouraging the creation of businesses in Spain.

The Entrepreneurs Act of September 27, although it seems to be clear about the problems that face the entrepreneur in Spain at the beginning of its business activity and on running its day-to-day business, does not meet the objectives of accelerating bureaucratic steps and encouraging those persons that really have a entrepreneurial spirit for the development and expansion of the same.

The Entrepreneurs Act leaves us certain good ideas that we hope that Spanish legislator has the possibility of working on them in the future to create a real entrepreneurial movement that leads Spain to the top of the countries in which is more easier to incorporate a company and which offers more legal resources to avoid troubles to the possible success of a business project.
