Abstract

The commentary analyzes the various judicial positions regarding the duration of birth leave in single-parent families, 16 weeks for one parent or 32, accumulating the leave as if there were two parents. Pending due legal reform, judicial pronouncements assume opposite criteria. The central nucleus of the debate resides in whether there is discrimination of the single-parent mother against the two-parent mother and/or, in her case, of the minor person cared for, interpreting article 14 CE in code of the Convention on the Rights of the Child. Finally, some procedural aspect is reported, important for the effectiveness of judicial protection ("judging and having the judged executed"). And this because the judgments favorable to the accumulation of permits present certain inconveniences for their execution.
