Evolution and critical aspects of the transnational posting of employees in the European Union

The purpose of this study is to analyse the posted of workers phenomenon ordered by undertakings established in a Member State of the European Union in the framework of a transnational provison of services to the territory of another Member State. Among the diverse reasons that motivates this study is the fact that Community legislation regarding these labour mobility through Directive 96/71/EC has been affected by a revision of the above mentioned Posting Workers Directive. Indeed the european legislators have adopted Directive 2018/957/EU of the European Parliament and of the Council of 28 June 2018 amending Directive 96/71/EC concerning the posting of workers in the framework of the provison of services. The new amendments aims at strengthening the guarantees of protective labour rules for posted workers as to ensure equal remuneration, new protective conditions and social security, outsourcing regulation, surveillance and control of the transnational fraud and the creation of mechanisms for administrative and sanctioning cooperation among the european Member States.
