The usage of franchises to descentralise the labour cost: new trends

The franchisor and the franchisee are legally independent entrepreneurs, all without prejudice to the supervisory powers that may be contractually established. Precisely, the control over the working conditions of the staff of the auxiliary company has recently served as a criterion for attributing responsibilities to the franchiser. In turn, the study shows an incorporated bias towards non-compliance given the conditions on the part of the franchised or auxiliary companies due to the control of the franchiser over the auxiliary or franchised company. On the other hand, experiences of articulated collective bargaining have been identified in the sense that both companies negotiate common working conditions. The mentioned three trends enhance the monitoring of working conditions by the franchisor.
