Abstract

The legal status of the contract of employment for a specific job or service has been traditionally set by law [arts. 15.1 a) and 49.1 c) ET) and by the regulations for its development (art. 2 RD 2720/1998), but can not be ignored the growing role that collective bargaining assumes in this area (mainly by reintroducing «contrato fijo de obra» which is the main object of this study) that, probably, will increase in view of the possibilities opened by modifications introduced by the Law 35/2010 on its 1st additional provision and article 15.1 a) of Workers Statute.

Thus, it can be argued that legal status of the contract of employment for a specific job or service is, and, increasingly, will be, the result of a conglomerate of legal and conventional precepts which all together define it. In the following pages this content and main problem will be approached through the prospect that provides its treatment for collective bargaining and, more specifically, from the perspective presented by the peculiarities of this regulation for the «contrato fijo de obra».
