Abstract

This paper aims to be an analysis of the figure of indefinite non-resident in the field of administration. First a review of the applicable legal regime, starting to do the analysis of judgments of the Supreme Court and various High Courts of Justice is done, trying to answer the most contentious issues that have arisen, case becomes remuneration or the exercise of certain rights. The most significant aspect that has is related to the legal consequences of the termination of the contract, and to treat it the most recent Supreme Court rulings, which involved a deep jurisprudential change are included. But this question is also discussed from the perspective of community Law, following addition to the issuance of an order by the Court of Justice of the European Union on this matter.
