Abstract

There is a unanimous consensus on the key role played by the collective bargaining in the 3/2012 Law. The big amount of Court decisions on the matter have been of great help to establish criteria and to limit the goals pursued by the legislator. This paper introduces the main decisions emanated by the Audiencia Nacional and Tribunal Supremo and analyses the jurisprudence established by them in their most conflictive elements.
