Abstract

In this study we try to analyze what is the legal regime of the situation of the worker when he is punished disciplinary with the suspension of employment and wage, which causes the suspension of his contract of employment. In view of the absence of express rules in this regard we have to turn to the judicial doctrine, jurisprudence and the scientific doctrine in order to find out which rights and duties are suspended and which remain in force, such as the computation of antiquity, the prohibition of unfair competition, the situation of registered and contribution to the Social Security or workplace conservation, among others. A lot of these issues aren’t obvious and the pronunciations in this regard aren’t always unanimous.
