Abstract

When female workers face traumatic and overwhelming situations such as domestic violence, their work life is inevitably impacted as well. This work aims to carry out an analysis with regard to the legal interpretation of the «absences motivated by the physical or psychological situation arising from gender violence» as a case excluded from the calculation of absenteeism, from the perspective of objective dismissal for absenteeism.

This is ultimately to analyze the specific legal regime of absences in the area of gender violence, envisaged by the Workers' Statute (Royal Legislative Decree 2/2015, of 23 October 2015) and the Organic Act 1/2004 dated December 28 on integrated protection measures against gender violence.
