Abstract

The commented judgment reiterates one of the traditional problems of labor law: the proof of overtime. Said problem worsens with the introduction of the irregular working day in our productive system; although it intends to be resolved with the daily record of the working day. The question raised in this judgment is precisely the problem of the company's lack of registration.
