Abstract

The case refers to a new company awarded a bus transport service in rural areas that doesn’t acquire the vehicle fleet of its predecessor because doesn’t meet the environmental requirements of the specifications. The judgment of the Court of Justice of the European Union of February 27, 2020, introduces a change of criterion in its Liikenne doctrine, isn’t recogniced.
