Abstract

In the context of a globalized world and general crisis, need of business flexibility measures in order to restructure and adapt to the circumstances at any time concurrent, has become a classic general principle of labour law –immobility of the workplace– in a meaningless rule. From a internal point o view, because the institute of workers’ transfer has been modified –especially in the last three years– to the point of protecting the free choice of the company; on an international basis, because new strategies offshoring and increasingly encouraged and facilitated transnational dimension of business worker to lead in fact to a migration in order to seek employment or, if necessary, keep having.
