Abstract

The aim of this paper is to analyze the stoppage of work which, according to article 44 of Law 31/1995, of 8 November, on Prevention of Occupational Risks, may order the Labour Inspection Unit when, in his view, the business failure of the legislation on prevention of occupational risks involving a serious and imminent risk for health and safety of workers.

This order is a preventive measure that aims to avoid immediate exposure of workers to situations of particular risk and whose infringement by the employer constitutes the administrative offense defined in article 13.3 of Royal Legislative Decree 5/2000 of 4 August, on Offenses and Penalties in the Social Order.
