Abstract

The 26/2009 Law of 23th December of General State Budget for 2010, following the precedent of previous financial years incorporates a number of provisions affecting Social Security, in a regulation that goes beyond the authorization of expenditure for that year or the related revenue estimates, since it includes changes that affect different areas of the Social Security system.

In this way, through Law 26/2009 is amended the regulation of the issue of settlement proceedings in Social Security contributions, the calculation of the regulatory base of the economic benefits for maternity and paternity leave and pensions of permanent disability, retirement, death and survival, the partial regulation of allowances for widows and orphans, the access to early retirement for specific groups, the provision of information required by the managing bodies of economic benefits, the range of management of Friendly Societies for of Occupational Accidents and Diseases of the Social Security or the power to impose sanctions for breaches in the social order.

In turn, at the end of the 2009 financial year two legal resolutions have been passed, which are, on the one hand, the 25/2009 Law of 22nd December about the modification of specific laws for their adaptation to the 17/2009 Law of 23rd November, on free access to activities of services and their financial year; on the other hand, there is the 27/2009 Law of 30th December that promoted urgent measures for the maintenance and fostering of employment and the protection of unemployed people, which affect the area of Social Security. Both laws change particular aspects of framing and affiliation (the second one) or areas related to instrumental or managing aspects.
